NHeLP Brief Outlines ADA Challenge to State Vaccine Mandate Prohibitions
The National Health Law Program released an issue brief examining how state laws prohibiting vaccine mandates may violate the Americans with Disabilities Act. The brief addresses recent state legislation weakening vaccine requirements and expanding exemptions, including Florida's announced intention to become the first state to prohibit certain public vaccine policies. NHeLP argues these prohibitions may unlawfully restrict access to safe environments for immunocompromised individuals and others with disabilities who rely on community immunity for protection.
Medicaid MCOs serving immunocompromised enrollees and populations with disabilities may face increased health risks and costs if state vaccine prohibition laws limit their ability to ensure safe care delivery environments.
