CMS ABA Toolkit Pushes States to Scrutinize High-Hour Autism Plans

CMS released a 173-page Applied Behavior Analysis Toolkit in August laying out federal best practices for how states should oversee and pay for ABA therapy under Medicaid. The toolkit carries no regulatory force, but it signals that stock, high-hour treatment plans could be viewed as a fraud risk indicator and repeatedly stresses that every patient needs an individualized, regularly updated treatment plan. It also names alternative behavioral and developmental models as valid options for state Medicaid plans, even as it leans heavily on ABA-centric guidelines. States will adopt the guidance unevenly since it is non-binding, but providers, payers and investors are already citing it in conversations about reining in ABA spending, which CMS data shows rose from $1.94 billion in 2021 to $10.1 billion in 2025.

Why it mattersABA providers and state Medicaid agencies face new pressure to document individualized treatment plans or risk having high-hour, cookie-cutter care flagged as a fraud, waste and abuse signal.
