Maryland CEO Indicted Over $100M COVID Test Billing Fraud

The Justice Department indicted Marc Aaron Potash, founder and CEO of Gaithersburg, Md.-based Tiero, on charges including conspiracy to commit healthcare fraud, healthcare fraud and transactions in criminally derived proceeds. Prosecutors allege Potash and co-conspirators used falsified documents to obtain a CLIA lab certification, then billed Medicare, Medicaid, the Federal Employees Health Benefits Program and other insurers for lab-based COVID-19 testing that never occurred. Instead, the company allegedly shipped over-the-counter self-administered tests nationwide while submitting claims with false service dates, locations and rendering providers, generating more than $50 million in payments from over $100 million billed. The alleged scheme ran from January 2022 to May 2026, and Potash faces up to 10 years in prison on each count if convicted.

Why it mattersThe case signals continued federal scrutiny of COVID-19 testing billing practices and underscores the fraud and compliance risks state Medicaid agencies and MCOs face from fraudulent CLIA certifications and false claims.
