DOJ, HHS Launch Six-Month False Claims Act Self-Disclosure Pilot

In a client alert, Hall Render reports that DOJ's Civil Division and HHS launched a Healthcare False Claims Act Self-Disclosure Pilot Program on October 22, 2026, jointly with HHS-OIG and CMS. The six-month program lets providers, suppliers, manufacturers, payors and related entities voluntarily disclose previously unknown potential FCA violations tied to federal health care programs in exchange for a coordinated resolution, with repayment multipliers of 1.25 to 1.6 times single damages, below OIG's typical 1.5x-plus and DOJ's typical 2x. Qualifying disclosures may also avoid a Corporate Integrity Agreement, CMS civil monetary penalties and enrollment revocation. Complete submissions are due by April 22, 2027, and late or partial submissions will not be accepted.

Why it mattersMedicaid-serving providers and payors with known compliance gaps have a narrow, firm-deadline opportunity to resolve potential FCA exposure at reduced financial and collateral risk before eligibility disappears once the government learns of the conduct.
