FTC Warns 24 Healthcare Companies on Price Transparency Compliance
In a client alert, Holland & Knight LLP reports that FTC Chairman Andrew Ferguson sent warning letters on October 5, 2026, to 24 of the nation's largest healthcare services companies. The letters state that providers must furnish patients with timely, accurate and complete pricing information under Section 5 of the FTC Act, in addition to existing CMS price transparency rules. The alert explains this signals the FTC may pursue unfair or deceptive practices enforcement against providers for pricing disclosure failures, independent of CMS enforcement mechanisms. No specific compliance deadline was announced in the letters.
Why it mattersProviders, including those serving Medicaid managed care populations, now face potential FTC enforcement exposure for pricing transparency gaps on top of existing CMS compliance obligations.
