HHS, DOJ Launch False Claims Act Self-Disclosure Pilot Program

HHS and the Department of Justice's Civil Division have launched a six-month pilot allowing healthcare companies to self-report potential civil False Claims Act violations in exchange for coordinated settlement terms. Qualifying companies must disclose full details of the conduct, provide supporting documents, describe remedial steps, and repay the government under a 1.25x to 1.6x multiplier based on factors like disclosure speed and leadership involvement. In return, companies receive a DOJ release, and HHS OIG will forgo exclusion or corporate integrity agreements while CMS will not revoke billing or enrollment privileges. Healthcare companies, including Medicaid managed care plans and providers, have until April 22, 2027 to submit disclosures electronically; incomplete or late submissions will not be reviewed.

Why it mattersMedicaid managed care plans and providers now have a defined, time-limited path to self-correct billing or compliance violations without facing exclusion, corporate integrity agreements, or loss of billing privileges.
