Court Trims Claims in Whistleblower Suit Against Ex-UVA Health Leaders

A federal judge in June partially granted motions to dismiss a lawsuit filed by four physicians against former UVA Health leadership, including ex-CEO K. Craig Kent, dismissing RICO claims and False Claims Act retaliation claims against individual defendants while allowing some retaliation claims against UVA and UVA Physicians Group to proceed. The judge also canceled the jury trial that had been set for late 2026. The physicians, who allege fraudulent billing and documentation practices occurred from 2020 to 2025 along with retaliation against those who objected, filed a revised complaint reasserting RICO claims; all defendants moved again to dismiss it in July. The court heard arguments Aug. 18 but has not yet ruled, and the defendants' sovereign immunity arguments remain unresolved.

Why it mattersThe case's outcome on False Claims Act retaliation theories and sovereign immunity for state academic medical centers could shape how health systems and their leaders face individual liability for alleged Medicaid and Medicare billing fraud allegations raised by physician whistleblowers.
