NLRB Certifies Union at Rogers Behavioral's West Allis Clinic
An NLRB regional director certified the National Union of Healthcare Workers as the bargaining representative for employees at Rogers Behavioral Health's West Allis, Wisconsin clinic, rejecting the company's challenges to the April election, which employees won 53-4. The decision follows a similar certification at Rogers' Madison clinic and an earlier NLRB finding that Rogers violated federal labor law before, during and after the election, including by firing six employees involved in organizing. Rogers acknowledged the certifications but would not say whether it plans to bargain or appeal to the full NLRB in Washington. A hearing on the related unfair labor practice complaint is scheduled for December.
Why it mattersBehavioral health providers participating in Medicaid networks face mounting labor law exposure and potential workforce disruption that can affect access to care for Medicaid behavioral health enrollees.
